Case No. 00 CIV 0183

Medical malpractice. Plaintiff claims Dr. Naumoff and Dr. Davies failed to properly diagnose her lung cancer. She died during litigation.

Verdict:  Defense verdict for Dr. Davies.  Plaintiff verdict against Dr. Naumoff for $600,000.00.

Case No. 01 CIV 0150

Breach of contract claim for Plaintiff's wedding reception at Vell's party center. Defendant agrees there was a mix-up but claims it was an honest mistake.

Verdict: Plaintiff's verdict $2,600


2-27-02    Prographics v. Merrick Graphics

Case No. 00 CIV 0148

Breach of contract claim. Plaintiff hired Defendant to print catalogues with address labels. Labels were not affixed rendering the catalogues less valuable.

Verdict: Plaintiff’s verdict for $12,000


2-28-02    Bomanite Design, Inc. v. Flescher

Case No. 01 CIV 0042

Plaintiff poured a colored, textured concrete deck for the Defendant. Plaintiffs claims they were not paid. Defendant claims the deck was defective.

Verdict: Plaintiff's verdict for $26,162

Defendant verdict for $10,120


3-11-02    State v. Berecz

Case No. 01 CR 0391

Defendant charged with theft from Applebee's restaurant where he was a server. Subsequent to the jury being impaneled, the Defendant pleaded guilty to theft.

Verdict: None. Defendant pleaded to charge.


3-25-02    Mladek v. Teynor's Homes

Case No. 00 CIV 0220

Plaintiff claims that the mobile home he purchased was defective.

Verdict: Plaintiff's verdict for $24,868


3-27-02    Stans v. Mitchell

Case No. 01 CIV 0111

Plaintiff claims the Defendant committed the intentional tort of assault and battery. The fight erupted when the ex-wife of the Defendant dated the Plaintiff. Defendant claims self defense.

Verdict: Defendant's verdict.


4-01-02    Cooperider v. Parker

Case No. 99 CIV 0336

Legal malpractice for negligently representing a family of a child struck by a car. The Plaintiffs claim that the attorney settled for less money than was available.

                                        Verdict: Defense verdict


4-15-02    State of Ohio v. Reese

Case No. 00 CR 496

Defendant was charged with felonious assault and aggravated assault. After the jury was impaneled the Defendant pleaded guilty to aggravated assault.

                                        Verdict: None. Defendant pleaded to lesser charge.


4-17-02    State v. Christburg

Case No. 01 CR 0393

Defendant is charged with rape, and two counts of kidnapping. Defendant claims the victim consented.

Verdict:  Guilty of Rape and one count of Kidnapping; not guilty of the second kidnapping.


4-29-02    Sirca v. Medina County DHS

Case No. 97 CIV 0121

Wrongful adoption claim. Plaintiff claims that MCDHS committed fraud in failing to advise and affirmatively misleading the adopting family of the child's medical history.

                                        Verdict: Defendant's verdict.


5-13-02    Roser v. Batyko

Case No. 01 CIV 0927

Leaky roof case. Home owner sues the seller and the real estate agency for an undisclosed roof leak.

Verdict: Plaintiff's verdict against Batyko for $6,800.

Defendant's verdict in favor of Kovack Realty and Mumaw.


5-20-02    State v. Girard

Case No. 00 CR 0343

Pandering obscenity involving a minor. Defendant admits he possessed the pictures but claims he was working for the FBI undercover at the time.

Verdict: Guilty of both charges.


5-24-02    Sandor v. Rymet

Case No. 00 CIV 0657

Auto accident with admitted liability. Causation issues.

Verdict: Defendant's verdict.


6-10-02    Grout Systems v. Schlabig & Associates, Inc.

Case No. 99 CIV 1058

Accounting Malpractice claim. An employee of the Plaintiff embezzled $270,000 and the Plaintiff sued its CPA for not discovering the theft.

                                        Verdict: Defendant's verdict.


6-12-02    Wisner v. Spires

Case No. 00 CIV 1142

Plaintiff was injured in a car crash in which she was a passenger. She sues the driver of her car and the other driver. Defendant claims the injuries were unrelated to the accident.

                                        Verdict: Plaintiff's verdict for $1,000


6-17-02    State v. Wade

Case No. 01 CIV 0436

Defendant charged with rape, kidnapping and sexual battery. Defendant claims consensual sex.

Verdict:  Guilty of Rape and Not Guilty of Kidnapping and Sexual Battery.


6-24-02    Austin v. Kluczarov

Case No. 99 CIV 0365

Plaintiff claims Defendant failed to properly construct a home. Defendant claims the Plaintiff committed fraud by promising payment he never intended to make to induce the Defendant to continue to work.

Verdict: Defense verdict on Plaintiff's claims.

Verdict for Defendant on his fraud claim $34,400 plus punitive damages of $4,325.


7-22-02    Nagy v. Giant Eagle

Case No. 01 CIV 0012

"Buckshot in the brisket" case. Plaintiff bought meat from Giant Eagle and broke her crown on a piece of buckshot. Defendant claims there was no buckshot in the meat.

Verdict: Defendant's verdict.


7-31-02    Murdock v. Krueger

Murdock v. Nowak

Case No. 00 CIV 0012

Two separate auto accidents in 1996 where Plaintiff claims she was injured. Both Defendants admit liability but deny causation and question damages.

                                        Verdict: Plaintiff's verdict against Nowak for $3,500

                                         Plaintiff's verdict against Murdock for $37,000.


8-26-02    Financial Pacific Leasing v. JAW Prof. Services

Case No. 01 CIV 0918

Business dispute relating to the sale of computer equipment and software. Plaintiff claims installment payments were not made and sues for them. Defendant claims breach of contract because the software is worthless without license which was not provided by Plaintiff.

                                        Verdict: Defendant's verdict on Plaintiff's claim.

                                        Plaintiff's verdict on Defendant's claim.


9-09-02    George v. Kammer

Case No. 00 CIV 0745

Commercial real estate construction dispute. Claim and counterclaim regarding breach of construction contract.

                                        Verdict: Plaintiff's verdict for $21,655.75.


9-16-02    State v. Cubic

Case No. 02 CR 0144

Possession of Heroin. Defendant claims he had cocaine, not heroin.

                                        Verdict: Defendant pleads to charge after jury selection.


9-17-02    State v. Paintiff

Case No. 02 CR 0070

Domestic Violence charge. Defendant claimed he was assaulted, not the victim.

                                        Verdict: Guilty of misdemeanor Domestic Violence.


9-23-02    Bishop v. Seville Bronze

Case No. 01 CIV

Plaintiff was injured when liquid bronze was sprayed on him at work. Plaintiff claims intentional tort against employer and product liability against clothing manufacturer.

Verdict: None. Settled after jury selected.


9-25-02    Barnes v. I.D. Images, Inc.

Case No. 01 CIV 0630

Employment discrimination claim, pregnancy firing alleged; Settled during voir dire.

Verdict: None. Settled during jury selection.


9-30-02    Hurban v. Trinastich

Case No. 02 CIV 0042

Rear-end auto accident with admitted liability. Defendant claims intervening accident caused damage.

                                        Verdict: Plaintiff's verdict for $60,000


10-7-02    Elioff v. Naumoff

Case No. 01 CIV 0130

Medical malpractice. Plaintiff alleges doctor failed to inform patient about abnormal test results. Defendant denies claim.

Verdict: Plaintiffs verdict against Defendant for $116,275.


10-21-02    State of Ohio v. Nott, Sr.

Case No. 02 CR 0222

Defendant charged with F-3 gross sexual imposition, F-4 importuning, M-1 public indecency. Defendant was accused by neighbor child of sex crime. Defendant denies allegation. Defendant pleaded guilty during trial.

Verdict: Defendant pleaded guilty to all charges during trial.


11-12-02    State v. Spoerke

Case No. 02 CR 0278

Defendant charged with F-5 vandalism of a business in which he was employed. Defendant denies charge.

                                        Verdict: Not Guilty


12-18-02    State v. Wertz

Case No. 02 CR 0289

Defendant charged with F-4 theft of an ATV. Defendant claims he thought it was his friend's ATV.

                                        Verdict: Guilty


12-30-02    Riazi v. Riazi

Case No. 01 CIV 0755

Family squabble surrounding loans father claims were gifts.
